TRANSFORMATION OF OWNERSHIP RIGHTS TO FLATS IN THE HOUSING STOCK MANAGED BY HOUSING COOPERATIVES

Abstract

Housing cooperatives, operating in Poland for over 120 years, are an important type of
entity on the market of residential real estate properties. The Act on Housing Cooperatives, of 15
December 2000, made it possible to transform cooperative rights to flats into separated ownership
by tenants, registered in a Real Estate Register, The resulting changes consist in tenants securing
more legal protection over the right to occupy their dwellings, but also in free turnover, management
and inheritance of owned flats. Until now, 29% of the housing stock has been within housing
cooperatives. The article discusses questions of the procedures and te rate of transformation of
cooperative rights to flats into separated onwership rights, as affected by subsequent amendements
to the act. Statistical data were presented that illustrate the course of privatization processes of the
housing stock belonging to housing cooperatives in Poland and in the Province of Warmia and
Mazury.
