LICENSE AGREEMENT AND CONTRACT FOR TRANSFER OF COPYRIGHT PROPERTY RIGHTS

The characteristic of proprietary property rights is their transferable nature. The basic method of consenting to the use of these exclusive rights by a third party is a license agreement, however, it is not uncommon, that property rights are transferred to another entity by contract.
Due to the variety of views of the doctrine, as well as the lack of precision of copyright regulations, the issue of the license agreement and the transfer of copyright still raises many doubts. The article is an attempt to discuss the principles of these agreements and the fundamental differences between them. These issues are analyzed on the ground of applicable legal provisions (in particular the Civil Code and the Law on Copyright and Related Rights), which indicates the practical nature of the work.
